It's still not valid; it's just one of those things that's set to be ignored in "TRANSITIONAL" 'cause it's so common.
XHTML STRICT pretty much eliminates cross-browser issues...except for IE, of course.
At least you have a fighting chance if it passes STRICT, otherwise you can chase rendering bugs around in a circle forever. Works here, doesn't work there...tweak...great, works there, uh oh, doesn't work here...tweak...etc.
